Terms of service

Effective 2026-09-24. The subscription terms for FoundingSite plans: scope, billing, changes, cancellation, content licenses, responsibilities, and exit.

Content requirement rendered as published text. Every section describes an adopted practice or names what is still to be adopted; nothing here claims a certification, entity, or practice that does not exist. The contracting entity, governing terms, and any jurisdiction-specific disclosures are inserted after legal review and before payments are accepted.

Seller and definitions

The seller is the contracting entity named at checkout. A collection is a reusable, nonexclusive website template; a plan is Presence, Studio, or Private Office; a member is one named person with access; an inbox is one connected business mailbox, available on Studio and Private Office; a connection is a verified software connection; service hours are separately quoted work recorded in 15-minute units, not a plan allowance.

Subscription scope and pricing

The subscription provides one company website in a chosen collection, the workspace, and the plan's allowances as published on the pricing page, which is the authoritative reference for every number.

Billing start, cadence, renewal, and price changes

Billing starts at explicit subscription, including setup. Monthly and annual cadences renew automatically until canceled. Price changes are announced at least 30 days before they take effect and never change a price during a paid period. Annual renewals are reminded 30 days in advance.

Plan changes and downgrades

Same-cadence upgrades take effect immediately with a prorated charge shown before confirmation. Cadence changes and downgrades take effect at renewal after any excess items are selected; nothing is deleted silently.

Cancellation and paid-through access

Renewal can be canceled at any time in Billing. Access continues through the paid-through date. Subscriptions cannot be paused.

Refund handling

Duplicate or erroneous charges are corrected. Prepaid periods are not routinely prorated on voluntary cancellation. If FoundingSite explicitly confirmed a core mailbox or workflow dependency and cannot supply it during initial setup, the customer may accept an agreed alternative or cancel with a refund of the initial charge. Applicable legal rights are not waived.

Content licenses

The customer owns its content and domain and grants FoundingSite a license limited to delivering the service. FoundingSite licenses the collection presentation for the subscription's duration; it is not transferred and is not exclusive.

Customer responsibilities

Rights to every image and claim, accurate business information including any required license disclosures, permissions from clients and photographers, lawful use of the mailbox and correspondence tools, and acceptance of the acceptable-use rules.

FoundingSite responsibilities and service scope

Operation and maintenance of the website and workspace, the plan's onboarding and service inclusions, support within the published service window, and the exit schedule. No response-time guarantee or uptime percentage is sold.

Suspension, termination, and exit

Failed renewals enter a seven-day grace period with retries on days 1, 3, and 5. After service ends: 30 days of owner-only export, removal from active systems by day 60, expiry of routine backups by day 90. The customer's domain is never held as security.

Liability, disputes, and changes

Liability allocation, dispute process, and governing terms are inserted after legal review. Changes to these terms are announced with an effective date.
